扫描“主播”｜“柴怼怼”的生意经：打假吸粉引流后售假，曾蓄意抹黑胖东来玉石质量

class=\"rich_media_content\"\u003e\u003cp\u003e近日，网红“柴怼怼”等人涉嫌生产、销售伪劣产品一案迎来进展。\u003c/p\u003e\u003cp\u003e涉案消费者通过“浙江公安”微信公众号“案件进度查询”确认，“柴怼怼”及其妻子肖某已被正式逮捕。页面显示，该逮捕处理时间为10月17日，距其被刑事拘留已过一个多月。\u003c/p\u003e\u003cp\u003e澎湃新闻记者了解，“柴怼怼”本名为柴某前，是一名玉石领域的自媒体博主，曾在短视频平台拥有27.4万粉丝。今年7月，“柴怼怼”因蓄意抹黑胖东来售卖的玉石质量，账号被依法依约关闭。后又因此前涉嫌生产、销售伪劣产品被立案侦查。\u003c/p\u003e\u003cp\u003e\u003c!--IMG_0--\u003e\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e因“打假”走红，却售卖假冒伪劣产品\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e“柴怼怼”最初以“揭露玉石行业的黑幕”“打假”为名，在短视频平台分享玉石知识、鉴定技巧等内容，吸引了一批对玉石感兴趣的粉丝。\u003c/p\u003e\u003cp\u003e但在“打假”的同时，“柴怼怼”和其妻子肖某也在短视频平台直播销售“武汉柴氏珠宝”，售卖玉镯、玉饰品等。在直播间中，他曾称自己售卖的珠宝“最差都得是宫里嫔妃戴的，从现在开始每半年涨10%，一年涨20%。”\u003c/p\u003e\u003cp\u003e然而不少消费者购买后发现，戴在手上的玉镯居然出现“颜色越来越浅“的情况。有消费者将自己在“柴怼怼”直播间19800元购买的“和田玉籽料玉镯”送到国家珠宝宝石首饰检验集团有限公司检测，被告知自己高价购买的“顶级和田玉籽料”，实际上是“和田玉（染色）手镯”。\u003c!--MID_AD_0--\u003e\u003c!--EOP_0--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_0--\u003e\u003cp\u003e消费者在网上曝光该情况后，引发不少消费者将从“柴怼怼”直播间买到的玉石送检，结果均检测出“染色处理”。对于不少消费者的退款诉求，“柴怼怼“曾承诺排队退款，但消费者却迟迟未收到退款。\u003c/p\u003e\u003cp\u003e有消费者在柴氏珠宝消费近10万元，然而其中官方鉴定该消费者购买的12件玉石饰品，总价近4万元，实际鉴定金额仅为3509元，截止至10月17日，该消费者仍有8万余元未被退回。\u003c/p\u003e\u003cp\u003e据第三方数据平台介绍，在“柴怼怼”封号前90天内，“柴怼怼”直播带货销售额为50万-75万元之间，场均销售额在5万-7.5万元左右。\u003c/p\u003e\u003cp\u003e然而除了销售伪劣玉石，“柴怼怼”的直播业务还拓展到了“白酒”“茶叶”。\u003c/p\u003e\u003cp\u003e其妻子肖某担任法定代表人的“平阳县小丫茶饮有限公司”生产销售的“中药茶饮”，被“柴怼怼”宣称有“排结石”功效，“柴怼怼”等在视频中称：“我那个时候结石已经很厉害了，然后一个疗程没喝完，尿的时候尿出来了。”此外，该公司还销售“排湿茶”，称“粉丝喝了以后肚子都变小了”。\u003c!--MID_AD_1--\u003e\u003c!--EOP_1--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_1--\u003e\u003cp\u003e然而不少消费者称服用了“柴怼怼”直播间购买的“中药茶饮”后，出现身体不适的情况。曾在“柴怼怼”直播间工作的前实习生“小鱼干”曾告诉媒体，这些服用“中药茶饮”的消费者，有癌症患者、肝病患者、鼻炎患者，“但不管什么体质，都被推荐服用同一款药。”\u003c/p\u003e\u003cp\u003e在越来越多消费者向监管部门投诉举报后，“柴怼怼”曾承认：“这事做的真不好，夸大宣传过，把贵州山上的农产品、野草野花野树根、猪吃的草，拿过来宣传成中药。”\u003c/p\u003e\u003cp\u003e7月22日，平阳县经查明认定，平阳县小丫茶饮有限公司通过抖音、微信宣传，以微信交易的方式销售祛湿、护肝茶等各类茶饮，但无法提供证据证明相关功效。当事人销售的茶饮产品未标明产品名称、产地、生产者或者销售者的名称信息。市监局依据《中华人民共和国反不正当竞争法》第二十条第一款的规定，责令商家自收到处罚决定书之日起立即停止违法行为，并处罚款220000元，上缴财政。\u003c!--MID_AD_2--\u003e\u003c!--EOP_2--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_2--\u003e\u003cp\u003e此外，“柴怼怼”还曾销售白酒，他将自己销售的酱香型白酒宣传为“20多年前购买”的库存老酒，并宣传该白酒具有“抗癌”，治疗高血压、高血糖、高血脂、耳鸣的功效。7月28日，温州市柴氏酒业有限公司因发布含有虚假内容的广告等行为，被平阳县市场监督管理局合计罚款6000元。\u003c!--MID_AD_3--\u003e\u003c!--EOP_3--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_3--\u003e\u003cp\u003e\u003cstrong\u003e因抹黑胖东来被封号\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e作为玉石赛道的博主，“柴怼怼”一直以来并未走进大众的视野。但今年4月，“柴怼怼”因“起底胖东来低成本玉石高价销售”在网上迅速走红。\u003c/p\u003e\u003cp\u003e4月5日，“柴怼怼”发布视频，指控知名企业胖东来的玉石业务是”以成本几百块钱的玉石卖几千几万，利润几十上百倍”“去胖东来买玉石的人，其实是交了智商税”，并扬言要在胖东来对面开店竞争。\u003c/p\u003e\u003cp\u003e这些言论成功引发了舆论关注，并为其带来了可观的流量，使该账号粉丝数在一个月内涨至27万多。尝到甜头后，“柴怼怼”连发多条有关胖东来的视频，并将该系列视频做成合集，放在账号主页最前面。\u003c/p\u003e\u003cp\u003e“柴怼怼”的行为迅速受到胖东来的反击。4月8日，胖东来商贸集团发布《关于“柴怼怼”网络侵权的回复说明》称，相关言论没有任何数据作为支撑，虚假结论严重伤害胖东来品牌和社会信任，涉嫌诽谤和不正当竞争。4月30日，胖东来公布法院受理案件通知书，起诉“‘柴怼怼’商业诋毁、侵犯名誉权”一案，已于4月25日在许昌市中级人民法院立案。胖东来的掌门人于东来也社交媒体发布多条动态来呼应“柴怼怼事件”。\u003c!--MID_AD_4--\u003e\u003c!--EOP_4--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_4--\u003e\u003cp\u003e然而“柴怼怼”也火速发视频回应，称不怕与胖东来对簿公堂、呼吁粉丝建立维权群对胖东来购买的玉石进行鉴定。“柴怼怼”对胖东来的攻击持续近2个月，共发布29条相关视频，对胖东来形象造成了巨大影响。\u003c/p\u003e\u003cp\u003e7月2日，网信中国微信公号发文称，抖音账号“柴怼怼”“怼怼柴”，小红书账号
